You agree that by clicking “Join Now”, “Join PulseConnect”, “Sign Up” or similar, registering, accessing or using our services (described below), you are agreeing to enter into a legally binding contract with PulseConnect (even if you are using our Services on behalf of a company). If you do not agree to this contract (“Contract” or “User Agreement”), do not click “Join Now” (or similar) and do not access or otherwise use any of our Services. If you wish to terminate this contract, at any time you can do so by closing your account and no longer accessing or using our Services.

The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and any or all Agreements: “Client”, “You” and “Your” refers to you, the person accessing this website and accepting the Company’s terms and conditions. “The Company”, “Ourselves”, “We”, “Our” and “Us”, refers to our Company. “Party”, “Parties”, or “Us”, refers to both the Client and ourselves, or either the Client or ourselves. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner, whether by formal meetings of a fixed duration, or any other means, for the express purpose of meeting the Client’s needs in respect of provision of the Company’s stated services/products, in accordance with and subject to, prevailing law of India. Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to same.

When you use our Services you agree to all of these terms. Your use of our Services is also subject to our Privacy Policy, which covers how we collect, use, share, and store your personal information.

Eligibility

PulseConnect Services are not for use by anyone under the age of 16.

To use the Services, you agree that you will only have one PulseConnect account with your real name and  you are not already restricted by PulseConnect from using the Services. Creating an account with false information is a violation of our terms, including accounts registered on behalf of others or persons under the age of 16.

Account

Members are account holders. You agree to use a strong password and keep it confidential;  not transfer any part of your account (e.g., connections) and follow the law and our list of Dos and Don’ts and Professional Community Policies. You are responsible for anything that happens through your account unless you close it or report misuse.

Payment

If you buy any of our paid Services (“Premium Services”) or any products sold on our platform , you agree to pay us the applicable fees and taxes and to additional terms specific to the paid Services. Failure to pay these fees will result in the termination of your paid Services. Also, you agree that:

• Your purchase may be subject to foreign exchange fees or differences in prices based on location (e.g. exchange rates).
• We may store and continue billing your payment method (e.g. credit card) even after it has expired, to avoid interruptions in your Services and to use to pay other Services you may buy.
• We may calculate taxes payable by you based on the billing information that you provide us at the time of purchase.

Platform

You agree that we will provide notices and messages within the Service, or sent to the contact information you provided us (e.g., email, mobile number, physical address). You agree to keep your contact information up to date.

Please review your settings to control and limit messages you receive from us. Our Services allow messaging and sharing of information in many ways, such as your profile, articles, group posts, links to articles, messages and In Mails. Information and content that you share or post may be seen by other Members, Visitors or others (including off of the Services). Where we have made settings available, we will honor the choices you make about who can see content or information

We are not obligated to publish any information or content on our Service and can remove it with or without notice.

Rights and Limits

As between you and PulseConnect, you own the content and information that you submit or post to the Services, and you are only granting PulseConnect and our affiliates the following non-exclusive license:

A worldwide, transferable and Applicable right to use, copy, modify, distribute, publish and process, information and content that you provide through our Services and the services of others, without any further consent, notice and/or compensation to you or others. These rights are limited in the following ways:

1. You can end this license for specific content by deleting such content from the Services, or generally by closing your account, except (a) to the extent you shared it with others as part of the Service and they copied, re-shared it or stored it and (b) for the reasonable time it takes to remove from backup and other systems.
2. We will not include your content in advertisements for the products and services of third parties to others without your separate consent (including sponsored content). However, we have the right, without payment to you or others, to serve ads near your content and information, and your social actions may be visible and included with ads, as noted in the Privacy Policy. If you use a Service feature, we may mention that with your name or photo to promote that feature within our Services, subject to your settings.
3. We will get your consent if we want to give others the right to publish your content beyond the Services.
4. While we may edit and make format changes to your content (such as translating or transcribing it, modifying the size, layout or file type or removing metadata), we will not modify the meaning of your expression.
5. Because you own your content and information and we only have non-exclusive rights to it, you may choose to make it available to others, including under the terms of a Creative Commons license.

You and PulseConnect agree that if content includes personal data, it is subject to our Privacy Policy.

You and PulseConnect agree that we may access, store, process and use any information and personal data that you provide in accordance with, the terms of the Privacy Policy and your choices (including settings).

You promise to only provide information and content that you have the right to share, and that your PulseConnect profile will be truthful.

You agree to only provide content or information that does not violate the law nor anyone’s rights (including intellectual property rights). You also agree that your profile information will be truthful. PulseConnect may be required by law to remove certain information or content in certain countries.

We may change, suspend or discontinue any of our Services. We may also modify our prices effective prospectively upon reasonable notice to the extent allowed under the law.

We don’t promise to store or keep showing any information and content that you’ve posted. PulseConnect is not a storage service. You agree that we have no obligation to store, maintain or provide you a copy of any content or information that you or others provide, except to the extent required by applicable law and as noted in our Privacy Policy.

PulseConnect reserves the right to limit your use of the Services, including the number of your connections and your ability to contact other Members. PulseConnect reserves the right to restrict, suspend, or terminate your account if you breach this Contract or the law or are misusing the Services (e.g., violating any of the Dos and Don’ts or Professional Community Policies).

Do’s and Don’ts

Do’s:

PulseConnect is a community of professionals. This list of “Dos and Don’ts” along with our Professional Community Policies limit what you can and cannot do on our Services.

You agree that you will:

1. Comply with all applicable laws, including, without limitation, privacy laws, intellectual property laws, anti-spam laws, export control laws, tax laws, and regulatory requirements;
2. Provide accurate information to us and keep it updated;
3. Use your real name on your profile; and
4. Use the Services in a professional manner.

Dont’s:

You agree that you will not:

1. Create a false identity on PulseConnect, misrepresent your identity, create a Member profile for anyone other than yourself (a real person), or use or attempt to use another’s account;
2. Develop, support or use software, devices, scripts, robots or any other means or processes (including crawlers, browser plugins and add-ons or any other technology) to scrape the Services or otherwise copy profiles and other data from the Services;
3. Override any security feature or bypass or circumvent any access controls or use limits of the Service (such as caps on keyword searches or profile views);
4. Copy, use, disclose or distribute any information obtained from the Services, whether directly or through third parties (such as search engines), without the consent of PulseConnect;
5. Violate the intellectual property rights of others, including copyrights, patents, trademarks, trade secrets or other proprietary rights. For example, do not copy or distribute (except through the available sharing functionality) the posts or other content of others without their permission, which they may give by posting under a Creative Commons license;
6. Violate the intellectual property or other rights of PulseConnect, including, without limitation, (i) copying or distributing our materials or (ii) copying or distributing our technology, unless it is released under open source licenses; (iii) using the word “PulseConnect” or our logos in any business name, email, or URL
7. Post anything that contains software viruses, worms, or any other harmful code;
8. Reverse engineer, decompile, disassemble, decipher or otherwise attempt to derive the source code for the Services or any related technology that is not open source;
9. Imply or state that you are affiliated with or endorsed by PulseConnect without our express consent (e.g., representing yourself as an accredited PulseConnect trainer);
10. Rent, lease, loan, trade, sell/re-sell or otherwise monetize the Services or related data or access to the same, without PulseConnect’s consent;
11. Deep-link to our Services for any purpose other than to promote your profile or a Group on our Services, without PulseConnect’s consent;
12. Use bots or other automated methods to access the Services, add or download contacts, send or redirect messages;
13. Monitor the Services’ availability, performance or functionality for any competitive purpose;
14. Engage in “framing,” “mirroring,” or otherwise simulating the appearance or function of the Services;
15. Overlay or otherwise modify the Services or their appearance (such as by inserting elements into the Services or removing, covering, or obscuring an advertisement included on the Services);
16. Interfere with the operation of, or place an unreasonable load on, the Services (e.g., spam, denial of service attack, viruses, gaming algorithms); and/or
17. Violate the Professional Community Policies or any additional terms concerning a specific Service that are provided when you sign up for or start using such Service.

Reservation of Rights

We reserve the right at any time and in its sole discretion to request that you remove all links or any particular link to our Web site. You agree to immediately remove all links to our Web site upon such request. We also reserve the right to amend these terms and conditions and its linking policy at any time. By continuing to link to our Web site, you agree to be bound to and abide by these linking terms and conditions.

Removal of links from our website

You don’t have to post or upload personal data; though if you don’t, it may limit your ability to grow and engage with your network over our Services.

Our Services allow you to stay in touch and up to date with colleagues, partners, clients, and other professional contacts. To do so, you can “connect” with the professionals who you choose, and who also wish to “connect” with you. Subject to your and their settings, when you connect with other Members, you will be able to search each others’ connections in order to exchange professional opportunities.

We use data about you (such as your profile, profiles you have viewed or data provided through address book uploads or partner integrations) to help others find your profile, suggest connections for you and others (e.g. Members who share your contacts or job experiences) and enable you to invite others to become a Member and connect with you.

It is your choice whether to invite someone to our Services, send a connection request, or allow another Member to become your connection. When you invite someone to connect with you, your invitation will include your network and basic profile information (e.g., name, profile photo, job title, region). We will send invitation reminders to the person you invited. You can choose whether or not to share your own list of connections with your connections.

Visitors have choices about how we use their data.

Our Services allow you to stay informed about news, events and ideas regarding professional topics you care about, and from professionals you respect. Our Services also allow you to improve your professional skills, or learn new ones. We use the data we have about you (e.g., data you provide, data we collect from your engagement with our Services and inferences we make from the data we have about you), to personalize our Services for you, such as by recommending or ranking relevant content and conversations on our Services. If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue.

All users can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit that information.

Subject to your settings, we let a Member know when you view their profile.
When you like or re-share or comment on another’s content (including ads), others will be able to view these “social actions” and associate it with you (e.g., your name, profile and photo if you provided it).
You may link your account with others’ services so that they can look up your contact’s profiles, post your shares on such platforms, or enable you to start conversations with your connections on such platforms. Excerpts from your profile will also appear on the services of others.

Use of PulseConnect Platform

You understand that except for information, products or services clearly indicated as being supplied by PulseConnect, we do not operate, control, or endorse any information, products or services on the Internet in anyway. You also understand that PulseConnect cannot and does not guarantee or warrant that files available for download through the PulseConnect Platform will be free of viruses, worms or other code that may be damaging. You are responsible for implementing procedures to satisfy Your particular requirements of Internet security and for accuracy of data input and output.

Disclosure of data

PulseConnect may disclose your Personal Data in the good faith belief that such action is necessary to:

• To comply with a legal obligation
• To protect and defend the rights or property of PulseConnect
• To prevent or investigate possible wrongdoing in connection with the Service
• To protect the personal safety of users of the Service or the public
• To protect against legal liability

You will use your username / password combination to access your account and it is your responsibility to keep this information confidential. You may change this information by logging into your account and following the Profile and Settings link. You are solely responsible for any and all use of your PulseConnect account including authorization by you to any third-party individual who may use your account. Any unauthorized access to your account should be reported immediately.

Should PulseConnect detect any instances of fraud, system abuse, defamation, harassment, foul language, inappropriate conduct in our forum or help-desk or any type of account activity deemed to be inappropriate or illegal in the sole discretion of PulseConnect, these actions may result in member termination and possible legal action as well as forfeiture of any earned commissions not yet disbursed to you from PulseConnect. In the event that you have taken inappropriate actions in attempting to cheat, steal, lie or any action that would violate the PulseConnect Privacy Policy that PulseConnect has a partnership agreement with, PulseConnect can at its own discretion turn over any and all evidence, information, personal data and logs to said 3rd party for possible prosecution or investigation.

Children’s Privacy

Our Services does not address anyone under the age of 18 (“Children”).

We do not knowingly collect personally identifiable information from anyone under the age of 18.
